Headlights coming the other way. They drift into your lane. You swerve to avoid.

But there is no dodging the 75 foot long 18 wheeler careening towards you. The 40 ton truck slams into your car. Upon impact, your whole world is turned upside down.
The laws of physics are stacked against you when an 18 wheeler is coming at you. Travelling at 65 miles per hour, it takes an 18 wheeler about a football field and a half to come to a stop. Your car’s crumple zones, air bags, and seatbelt are simply no match for the force of impact when you get hit by a commercial motor vehicle.

The commercial motor vehicle safety laws are not much help

The U.S. Department of Transportation (USDOT) and the Federal Motor Carrier Safety Administration (FMCSA) balance your safety with trucking companies’ profits. In 2020, the USDOT extended the amount of time truckers can spend behind the wheel without taking a break to sleep. Jim Hoffa, the General President of the International Brotherhood of Teamsters had this to say about the change: “In an effort to increase so-called ‘flexibility’ for trucking companies, the FMCSA is abandoning safety and allowing drivers to push themselves to the limit even further. Trucking is already one of the nation’s most dangerous jobs. We shouldn’t be sacrificing the health and safety of drivers just to pad the profits of their big business bosses.”

Finally, there is the trucking company’s insurer. Although the USDOT requires commercial motor vehicles to carry $750,000 in liability insurance, the insurer’s profits depend upon avoiding responsibility and paying crash victims the least amount possible in compensation for their injuries.

With all of these forces working against you, you need a team of experienced attorneys to protect you.
